DRAFT AFFIDAVIT “CONCENT CUM UNDERTAKING”
1. Reference is made to your letter No. Dated .
2. In response to your abid letter it is intimated that the draft
affidavit “CONCENT CUM UNDERTAKING” forwarded by you does not appear to
be in accordance with the contract agreement signed by you as builder
and I as buyer. It also does not appear to be anywhere in my interest as
buyer.
3. Therefore in view of the above, you are requested to
answer following questions so as to clear our doubts and
apprehensions:-
(a) What is your proposed change in earlier sanctioned layout and building plan? Please forward a copy of the same.
(b) What are the change in conditions ………………
(c) How many additional floors are you proposing in contravention to
your earlier plan promised in brochure and contracted with us?
(d) For increase in FAR has the approval of concerned Department with
special reference to the builders project name site falling in seismic
zone 4 been obtained? If yes please forward a copy of the same.
(e) Please confirm if the necessary NOC for Height Clearence from
Airport Authority, for proposed increase in FAR has been obtained. If
yes, then please forward a copy of the same.
(f) Please confirm
that the necessary NOC of Chief Fire Officer, Gautambudh Nagar for
proposed increase in FAR has been obtained. If yes, then please forward a
copy of the same.
(g) Confirm that your proposed increase in
FAR plan is not going to affect the earlier approved plan at the time of
your contact execution with us in terms of open space for common
utility like garden, arboriculture, pathways, parking space, and
community services promised by you. Also, give your detailed plan and
justification as to how the increase in FAR will not affect the same?
(h) Confirm whether additional land has been purchased for the
construction of podiums over and above the earlier approved plan? If no
then which ground area is planned to be compromised for the same and
which facility will be denied?
(i) Please inform all those
facilities promised to us on allotment of unit, brochure etc. that will
be denied on with increase in FAR, increase in height of towers,
increase in number of units, construction of podiums as mentioned at
para 1 of your draft “CONCENT CUM UNDERTAKING” forwarded by you.
(j) Please inform your Construction schedule and new construction linked payment plan.
(k) Confirm if banks have started disbursing loans on Project Name? If
yes then name of banks, so that arrangement of future instalments could
be made, since you at the time of booking had confirmed that your
project is approved for loan by banks.
(l) Please confirm that
with increase in FAR, there will not be any compromise in building by
laws and the provisions of the “National Building Code”.
4. You
are requested to provide detailed information as asked at para 3 above,
so that your aforesaid draft affidavit could be considered for our
further necessary action.
